Blame BC Judges For Crime Problem

Back in May Maclean’s published an article given their thoughts on how British Columbia managed to become an international crime super power. The article offers an interesting point of view, one that has more merit than any reason I could ever come up with and spin, but at the end of the day British Columbia has an international crime problem because there are people in positions of authority in BC who hand down weak punishment for crimes and then justify that punishment with their own interpretation of how the laws are to be understood and applied.

It’s and absolute joke, and a crime is a crime whether it is committed by a member of organization criminal organization or your next-door neighbour.

There a judges in BC who deliberately go out of their way to f**k up when they are presiding over criminal court cases where there is overwhelming evidence against the accused. I have spoken of such judges here in Crooked in Canada.

Those judges go out of their way to hand down rulings that they know will favour the accused, and they justify their actions by saying, “Well the way I interpret the law, blah, blah, blah, is telling me that this particular law doesn’t apply to so and so because the law as it applies, blah, blah, blah, may or may not infringe on the accused rights, blah, blah, blah, and despite the evidence before me, the 5 kilos of cocaine, the murder weapon, the video surveillance, eyewitness accounts, the stolen property, the tattoos and colours associated with organized crime, blah,blah, blah, I am not prepared to convict the accused because his or her rights have been infringed upon and the law as it is written cannot be applied to the accused because my interpretation is that the accused isn’t the type of criminal that the existing law applies to, blah, blah, blah…”

A question for judges across the country, “Do you really think very many of the 33 million or so people living in Canada care about whether a member of an outlaw motorcycle gang, an Asian gang member, a Russian gang member or any gang member for that matter, a murderer, drug-dealer, bully, arsonist, rapist, thief, kiddie diddler, child-sex predator, or bank robber’s constitutional rights should be respected once there is enough evidence to convict them of the crime they are accused of?

All up, the problems in British Columbia can be mostly attributed to the judges who don’t convict and sentence out of fear of violating an accused’s rights because they can’t grasp the grammar and language the laws they are sworn to uphold are written in, are suffering from irrational thoughts due to stress factors in their lives, drugs, alcohol maybe. Perhaps too many bumps on the head, deterioration of the mind due to the “age factor”, or in some case because they are being paid off or threatened.

British Columbians can also blame the police for spending too much time building a case when they already have enough evidence to bring forth charges. The more time they spend stacking up evidence against the accused looking for that “slam dunk” conviction, the more likely they are to infringe upon a criminal’s constitutional right. There is more margin for error when its gather, gather, and gather evidence that in the end, does nothing to ensure lengthy sentences or that judges and juries will even convict. If a criminal offence has been committed bust them right away, don’t waste taxpayers money trying to build a bigger case because it doesn’t work anymore thanks to judges who think they know better.

If British Columbia wants to be taken off the international crime map the province and the feds need to get tougher with criminals, especially members of organized crime. By applying the maximum sentence (first time offender or not), deporting the convicted once their sentences are completed (no appeals, no nothing), and limiting the amount of protection their rights deserve if only because they have been arrested and charged, or, convicted of a criminal code offence.

I’m not saying that the charged and convicted right’s shouldn’t be protected, I’m just saying that not all their rights should be protected when they are charged and/or convicted. Judges presiding in criminal court cases should not be using the Bill of Rights and Canadian Constitution to protect the accused from conviction or serving prison time when the evidence against the accused is enough to convict. If there is a problem with their rights having not been protected during the investigation and ensuing prosecution, then accused criminals can do what everybody else who feels their rights have been violated, they can damn well sue.

Criminal court is for criminal code offences not for protecting individual rights and freedoms of the accused. That’s for another part of the judiciary to decide. Judges presiding over criminal court cases across Canada, never mind BC need to spend less time interpreting criminal laws and more time applying criminal laws, and less time protecting a criminals rights and more time considering the effect those criminals have had on the rights of their victims. Until they come to that realization, or are forced to come to that realization, the BC problem with international crime will continue, and eventually spread to the same levels across Canada.

Last but certainly not least, IT’S TIME TO BRING IN A 3-STRIKE LAW FOR THOSE PEOPLE CHARGED AND CONVICTED OF AN INDICTABLE OFFENCE. ENOUGH ALL F**KING READY!
